Lexus Extra Care Protection

Hello,

We bought an used 2008 Lexus RX350 4 years ago.

At the time, the sales person sold us the Extra Care Protection for $ 2,700.

This was titled as 3Y/ 180,000 and we were given the explanation as the warranty is covered for 3 years / 180,000 whichever comes first. But if we have not used it by the end of this period, we get that money back.

We very well remember this condition and recall something in writing where we signed.

Whenever we met the sales person, we made sure to ask if this is still valid and he said yes, and we have only this much months to get that money back as we hadn't used it.

When the time was up, we followed up and the sales person was no longer there and the new staff is saying there's no such thing. Whether we use it or not we have already paid that money and that doesn't come back.

Unfortunately, we can't find anything on our papers now with such a condition and perhaps they had handwritten that condition only in their papers where we might have signed.

has anyway out there faced this type of an issue?

How can we fight for our money?

The contract you signed, and which you indicate that you have a copy of, documents the terms of the warranty including any pro-rated refunds that might be issued if the warranty is cancelled during the warranty period.

There is nothing to "fight" for unless this full refund is documented in the contract. A service warranty that provides a full refund if no claims are filed would certainly be wonderful. I retired from an underwriter of vehicle service warranties and I've never heard of such a thing.

I've always found that getting money back is much more difficult that sending it away. Lesson learned OR a LOT of work. Totaled a year old Nissan once with the extended thing. Never saw a dime back, not even one with the Queen.
