What's This About Not Being Able To Turn Off Driver Assist?

I read in a few places that some people have issues with their IS250/350's because Driver Assist or Traction control is always on and the only way to turn it off is using the e-brake. Is this true? And if it is true, do u guys think its such a big deal?

It's not really a big deal but word has gotten around on how to defeat it anyway.
